Terms of use
For this website and its demos. The agreement that governs a game in a casino is signed, and it is not this.
Provisional: this document is not approved yet
Everything below is a draft. It becomes the studio's approved position only when every administrator has signed this exact version in the client area. Until then, read it as an accurate description of what we do and intend, not as a document anybody has signed off.
Written in-house, not reviewed by a lawyer, and no Maltese entity exists yet to be a party to it. What approval means here
1. What these terms are
These terms govern your use of this website and the game demos on it. They are not a supply agreement, they are not a licence to any game, and nothing on this site is an offer capable of acceptance. A game of ours running inside a casino does so under a signed written agreement between the studio behind Getaway Gaming and that operator, which is not published here and is not varied by anything on this site.
If you are reading this because you are evaluating us as a supplier: the documents your process needs are a supply agreement, a schedule of the games, a data processing agreement and the certification packs for the builds you would run. Ask, and they come with a person attached rather than a download.
There is no company to be a party to this yet
Getaway Gaming is not yet incorporated. Until it is, these terms are a published statement of the basis on which this website is offered. They bind what you may do with the site, and they cannot create obligations for a legal person that does not exist. The legal information page says which particulars are missing and why.
We are telling you this rather than printing a limitation of liability in the name of a company that has no registration number. That clause is below, and it will mean something the day there is somebody for it to protect.
2. Who this site is for
This site is written for licensed gambling operators, their compliance and integration teams, regulators, test houses and people looking for a job here. It is not written for players, and it is not a place to gamble.
No real-money play is offered anywhere on this site. No money can be deposited, no stake can be placed, no winnings can arise and no prize of any kind can be won. The age confirmation on the front door is there because the subject matter is gambling, not because there is anything behind it to be of age for.
3. The demos, and the figures beside them
The demos replay rounds that were recorded in advance from the certified maths, in a fixed rotation. They are a faithful demonstration of how a game behaves and they are not a sample of its return: the figure a demo realises over its whole rotation is a property of the rotation, not of your luck, and the pools are generated to sit on the certified return for exactly that reason.
A demo balance is a number on a screen. It has no value, it cannot be withdrawn, transferred, exchanged or carried between visits, and nothing about how you play one reaches us.
Where a figure is published next to a game (its return, its hit rate, how often a feature lands, its maximum win), that figure is read out of the certification pack that measured it and carries the interval it was measured to. It describes the certified maths, not the demo in front of you.
4. What belongs to whom
Everything on this site belongs to the studio behind Getaway Gaming or to the people it licenses it from: the games and their names, the artwork, the mark, the text, the layout, the code and the published figures. None of it is placed in the public domain by being published. The two typefaces this site is set in are licensed from their foundries under the SIL Open Font Licence and belong to them.
You may read this site, link to any page on it, print a page, and quote a short passage with attribution. That includes the one-page game sheets, which exist to be printed and forwarded. You may not copy the games or any part of their maths, artwork, sound or code; reverse engineer, decompile or disassemble anything served from here except to the extent that a law says that right cannot be excluded; present any of it as your own; or use it to train a machine learning model.
5. What not to do with it
Do not try to break in, overload it, scan it for weaknesses without reading the security page first, scrape it in a way that degrades it for anybody else, strip or alter the figures and then republish them, or use it to do something unlawful in your own country.
This is not enforced by a clause. The site has no accounts and nothing to suspend; what actually happens to traffic that behaves like an attack is that the infrastructure in front of it stops answering. The security page says how to test us deliberately and legitimately.
How to test us on purpose, and the safe harbour for doing it
6. What we do and do not promise
This site is offered as it is. We do not promise that it is available, uninterrupted or error-free, or that any page is complete. We would rather say that plainly than bury the usual list of disclaimed warranties in capital letters.
What we do commit to is narrower and more useful: every figure published about a game is derived from the artefact that measured it rather than typed, and a page that cannot derive one says so instead of showing an old one. If you find a figure on this site that its own certification pack does not support, that is a defect and we want to hear about it.
Nothing on this site is legal, regulatory, financial or compliance advice. It describes what we have built and what we have read. Your own obligations in your own market are yours, and a market pack of ours is our reading of an instrument rather than a legal opinion on it.
7. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else a law does not allow to be limited. That carve-out comes first because it is the part that is not negotiable.
Subject to that, and to the extent the law allows: we are not liable for any loss arising from your use of this website or the demos on it, including lost profit, lost business, lost data or any indirect or consequential loss. This is a free informational website with no accounts and no payments. The liability that matters to an operator lives in the supply agreement, with its own caps, indemnities and service levels, and not here.
8. Links off this site
Some pages link off this site: a regulator's own register, an instrument on EUR-Lex or the Laws of Malta, a help line for problem gambling, a reference game's own vendor page. We link to them so a reader can check a claim rather than trust it, and we are not responsible for what is on the other end or what changes there.
The cookies and storage page lists the handful of hosts your browser actually connects to while reading this site, which is a different and shorter list than the things we link to.
9. The client area
The client area behind the sign-in is a different surface with its own rules. Access is granted to a named person for a stated reason and for a stated period, it is logged, and it can be withdrawn. What you can see there is decided by your role on the server and never by the page you can reach.
If you have an account: credentials are personal and are not to be shared, what you see there about an unreleased build or an unpublished figure is confidential, and anything you do there is attributable to you. If you believe somebody else has your credentials, the security page is the fastest route to a human.
10. Changes to these terms
These terms can change. The version and the date it took effect are on the legal information page, and this site's full history is in a public commit log, so what changed and when is checkable rather than announced. We do not keep a mailing list for this.
11. Law and forum
These terms are governed by the laws of Malta, and any dispute arising out of them or out of your use of this website goes to the courts of Malta. Nothing in this clause removes a protection that the law of your own country of residence gives you and does not allow to be contracted away.
If a clause in these terms turns out to be unenforceable, the rest stands and the unenforceable one is read down to what the law allows rather than taking the document with it.
Contact
Anything about these terms goes to hello@getawaygaming.com, which is also the address in the imprint. The postal address is the registered office on the legal information page, once there is one.
